1. Introduction
This Privacy Policy governs the collection, storage, processing, disclosure, and protection of personal data of Empathy Listeners (“you”/“Listener”) on the sayHey platform, operated by Mindorphin Private Limited previously known as KMR & Friends Pvt. Ltd., a company incorporated under the laws of India. This policy is in accordance with the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
2. Definitions
- Company / We / Us / sayHey – Refers to Mindorphin Private Limited previously known as KMR & Friends Pvt. Ltd.
- Empathy Listener / Listener / You – Refers to certified individuals onboarded to listen empathetically to Users on the sayHey platform.
- User – Refers to an individual who avails support services through sayHey.
- Platform – Refers to the sayHey mobile applications, websites, backend systems, and affiliated services.
- Personal Information – Refers to any data that relates to a natural person which, either directly or indirectly, can be used to identify that person.
- Sensitive Personal Data – Includes passwords, personal data, bank account details, KYC, Profile Image
3. Information We Collect
- Full name, gender, contact details, date of birth, location
- Educational qualifications and work history
- Responses to internal assessments
- Login data (browser, device, OS, IP address, location, timestamps)
- Communication records (email, messages)
- Profile photo
4. Purpose of Collection
- Verification and certification as a sayHey Empathy Listener
- Listing and matching you with Users
- Internal training, audits, and quality checks
- Session analytics (no session is recorded unless consented)
- Processing payouts
- Communication about platform updates and support
- Legal or regulatory compliance
5. Consent
By registering as an Empathy Listener, you provide express consent to:
- Collect and process your personal and professional information
- Share anonymized details for training, analytics, or promotional purposes
- Receive platform-related communication via email, SMS, or app notifications
You may withdraw consent by deregistering from the platform. Upon withdrawal, we shall deactivate your profile and initiate the deletion of associated data subject to applicable retention requirements.
6. Data Confidentiality & Sharing
We are committed to maintaining strict confidentiality. However, data may be shared:
- With government authorities if mandated by law
- When there is risk of harm to self or others
- With platform partners involved in improving platform functionality (under strict NDAs)
- For legal claims, dispute resolution, or regulatory purposes
You must delete all User data in your possession upon exit from the platform. Unauthorized use of User data will lead to immediate termination and possible legal action.

Our platform uses cookies and app usage analytics to enhance user experience. These include:

Please note: We do not record calls or chat sessions. However, basic session metadata may be stored for operational and performance analysis.
10. Rights of the Listener
You may:
- Access and update your profile at any time

- Request account deletion and associated data (post deregistration)
11. Data Retention
Listener data will be retained:
- As long as you are active on the platform
- For a maximum of 3 years post deregistration, or longer if required under Indian law
12. Amendments to Policy
sayHey reserves the right to revise this policy at any time. Updated policies will be published on our platform. Continued usage of the platform after updates constitutes your acceptance of the revised terms.
13. Governing Law and Dispute Resolution
This Privacy Policy shall be governed by the laws of India. All disputes shall first be attempted to be resolved through arbitration in Mumbai, India, as per the Arbitration and Conciliation Act, 1996. If unresolved, courts in Mumbai shall have exclusive jurisdiction.
